Promotion Appeals

A promotion appeal can be made against a provisional promotion in excess of 6 months if the selection constitutes a promotion for both the appellant and the promotee, and both are NTPS employees. Public Sector employees cannot appeal against the appointment of a person from outside the Public Sector or against a transfer. Also, in accordance with Regulation 5(a) of the Public Sector Employment and Management Regulations, promotions of employees to Executive Contract Officer designations are not subject to appeal.

Appeals against promotions in accordance with 30(1)(b) [direct appointment] are open to all employees.  In all other appeals, appellants need to have been an applicant for the vacancy, or if not, must obtain written approval to appeal from the Commissioner for Public Employment. 

Sections 55 and 56 of the Public Sector Employment and Management Act and Part 3 Division 1 of the Public Sector Employment and Management Regulations provide the legislative basis for appeals against provisional promotions in the NTPS.
