Public Sector Instruments

Under the Public Sector Employment and Management Act, the Commissioner for Public Employment can delegate his powers to the Chief Executive Officer of an agency.  Currently 15 Public Sector Instruments have been issued.

No. 1   Employment Records 

This PSI provides for the CEO to maintain employment records within the agency in accordance with section 17 PSEMA.

No. 2   P1/P2 Progression Scheme

This PSI enables agencies to advertise nominated P1 positions as a multi-designation P1/P2, to allow for career progression within an agency.  The nominal incumbent of the P1 position can be directly promoted to the P2 level subject to meeting the requirements of the P2 level, without the agency having to advertise the P2 position in accordance with section 30(1)(b) and section 30(2) PSEMA.

No. 3   Selection Without Advertising for Aboriginal and Torres Strait Islander Cadetship Program

Under this PSI the CEO of an agency can directly appoint or transfer a person to a cadetship in accordance with Section 30(1)(b) PSEMA.

No. 4  Renewal of Fixed Period Employment for Trainees

This PSI enables the CEO of an agency to renew a temporary contract on more than one occasion in accordance with Section 34(5) PSEMA for Trainees only.

No. 5   Not Issued

No. 6   Selection Without Advertising Where Vacancy

Previously Advertised Within the Last 6 Months.  Under this PSI if a position becomes vacant within 6 months of being advertised, the CEO can select another applicant who was deemed suitable from the original selection process.

No. 7   Selection Without Advertising for Trainees

This PSI has been revoked by Public Sector Instrument No. 11.

No. 8   Renewal of Fixed period Employment for Base Grade Designations

This PSI allows the CEO to renew on more than one occasion in accordance with Section 35(5) PSEMA employees employed at the AO1/AO2/T1/P1 or Phy 1-4 levels.

No. 9   Revoked by Public Sector Instrument No. 13.

No. 10 Selection Without Advertising for National Indigenous Cadetship Program (NICP)

This PSI allows a CEO to select without advertising in accordance with section 30(1)(b) PSEMA a person for the NICP.

No. 11 Selection Without Advertising for New Apprentices and Trainees

Under this PSI the CEO can select without advertising in accordance with section 30(1)(b) PSEMA a person as a New Apprentices and/or Trainee.  This PSI also revokes Public Sector Instrument No. 7.

No. 12 Selection Without Advertising – Entry Level Recruitment Program

Under this PSI the CEO can select without advertising in accordance with section 30(1)(b) PSEMA for a base grade position, a person  the Entry Level Recruitment Scheme.

No. 13 Approved Medical Practitioners

The PSI has been revoked.

No. 14 Delegation of a number of the CPE’s powers under PSEMA and PSEM By-Laws to CEO’s

Under this PSI the CEO can determine the meaning of “dependent” under specific By-Laws listed in the Schedule with respect to employees of the CEO’s Agency.  This PSI allows the CEO to approve one extension of the time limit under By-Law 51(5).

No. 15 Renewal of Fixed Period of Employment (All Classifications)

This PSI allows the CEO to renew on more than one occasion all classifications of employees in accordance with section 34(5) PSEMA and subject to specified conditions.

No. 16 Selection Without Advertising – In Remote Communities

Under this PSI the CEO can select without advertising in accordance with section 30(1)(b) PSEMA to perform for a period exceeding 6 months the duties of a position classified as AO1, AO2, PH 1 or PH2 in the specific localities.
